Terms and Conditions for Accommodation Contracts(E)

Scope

Article 1

  • Terms and Conditions for Accommodation Contracts and related contracts concluded between Seagaia Forest Condominiums / Seagaia Forest Cottages (hereinafter referred to as "this Facility") and guests shall be governed by these terms and conditions, and any matters not stipulated in these terms and conditions shall be governed by laws, regulations, or generally accepted practices.
  • If this facility enters into a special agreement to the extent that it does not violate laws, regulations, or customs, that special agreement shall take precedence, notwithstanding the provisions of the preceding paragraph.

Application for accommodation contract

Article 2

  • Anyone who wishes to apply for an accommodation contract with this facility must provide the facility with the following information:
    • Guest name
    • Date of stay and expected arrival time
    • Accommodation fees (in principle, based on the basic accommodation fees in Appendix 1)
    • Other matters deemed necessary by the facility
  • If a guest requests, during their stay, to extend their stay beyond the date specified in item 2 of the preceding paragraph, this facility will treat this request as an application for a new accommodation contract at the time the request is made.

Establishment of accommodation contract, etc.

Article 3

  • An accommodation contract shall be deemed to have been established when this facility accepts the application set forth in the preceding paragraph. However, this does not apply if this facility proves that it did not accept the application.
  • When an accommodation contract has been concluded pursuant to the provisions of the preceding paragraph, an application fee set by this facility, limited to the basic accommodation fee for the period of stay (3 days if it exceeds 3 days), will be required to be paid by the date specified by this facility.
  • The application fee will first be applied to the accommodation fee to be paid by the guest in full, and in the event that a situation arises in which the provisions of Article 6 and Article 18 apply, it will be applied to the penalty charge and then to compensation, in that order, and the remaining balance, if any, will be refunded at the time of payment of the accommodation fee as provided for in Article 12.
  • If the guest fails to pay the amount of the application fee set forth in paragraph 2 by the date specified by this facility in accordance with the regulations, the accommodation contract will become invalid. However, this only applies if this facility notifies the guest to that effect when specifying the due date for payment of the application fee.

Special agreement waiving the application fee

Article 4

  • Notwithstanding the provisions of Paragraph 2 of the preceding Article, this facility may enter into a special agreement stipulating that payment of the application fee stipulated in the same paragraph is not required after the contract is concluded.
  • If, when accepting an application for an accommodation contract, this facility does not request payment of the application fee stipulated in Paragraph 2 of the preceding Article or does not specify a due date for payment of said application fee, it will be treated as if the special agreement stipulated in the preceding paragraph has been accepted.

Refusal to enter into an accommodation contract

Article 5

This facility may not accept the conclusion of an accommodation contract in the following cases:

  • When the application for accommodation does not comply with these terms and conditions.
  • When the Hotel is fully booked and there are no Guest rooms available.
  • When the Guest seeking accommodation is deemed liable to conduct himself or herself in a manner that will violate the laws, public order or good morals in regard to his or her accommodation.
  • When the person seeking accommodation can be clearly detected as carrying an infectious disease.
  • When the Hotel is asked to assume an unreasonable burden in connection with its accommodation.
  • When it is impossible to provide accommodation due to natural disasters, malfunction of facilities, or other unavoidable reasons.
  • When a guest seeking accommodation is deemed to be intoxicated or otherwise likely to cause significant inconvenience to other guests, or when a guest behaves in a manner that causes significant inconvenience to other guests (as stipulated in Article 10 of Miyazaki Hotel and Inn Business Law Enforcement Ordinance).

Guest's Right to Cancel Accommodation Contract

Article 6

  • Guests may cancel the accommodation contract by notifying this facility.
  • If the guest cancels the accommodation contract in whole or in part due to reasons attributable to the guest (excluding cases where the facility has specified a payment date for the application fee and requested payment pursuant to the provisions of Article 3, Paragraph 2, and the guest cancels the accommodation contract before payment), this facility will charge a penalty as listed in Schedule 2. However, this applies only if the facility has entered into a special agreement as set forth in Article 4, Paragraph 1, and, in entering into such special agreement, has notified the guest of the obligation to pay a penalty in the event that the guest cancels the accommodation contract.
  • If a guest does not arrive by 8:00 p.m. on the day of their stay (or by two hours after the expected arrival time if the guest has specified it in advance) without contacting our facility, we may consider the accommodation contract to have been cancelled by the guest.

Right to cancel the facility contract

Article 7

  • This facility may cancel the accommodation contract in the following cases.
    • When the Guest is deemed liable to conduct himself or herself in a manner that will violate the laws, public order or good morals in regard to his or her accommodation, or when it is deemed that he or she has already conducted himself or herself in such a manner.
    • When the Guest can be clearly detected as carrying an infectious disease.
    • When the Hotel is asked to assume an unreasonable burden in connection with its accommodation.
    • When it is impossible to provide accommodation due to a natural disaster or other force majeure event.
    • When a guest seeking accommodation is deemed to be a nuisance to other guests due to excessive intoxication, or when a guest behaves in a manner that significantly disturbs other guests (as stipulated in Article 9 of the Miyazaki Hotel and Inn Business Law Enforcement Ordinance).
    • When the Guest smokes in bed, tampers with fire-fighting equipment, or fails to comply with other prohibited actions in the Usage Regulations stipulated by the Hotel (limited to those necessary for fire prevention purposes).
  • When this facility cancels the accommodation contract in accordance with the provisions of the preceding paragraph, the guest will not be charged for any accommodation services, etc. that have not yet been provided.

Accommodation Registration

Article 8

  • Guests will be required to register the following particulars at the front desk of this facility on the day of their stay.
    • Name, age, sex, address and occupation of the guest
    • For foreigners, submit your passport
    • Departure date and scheduled time
    • Other matters deemed necessary by the facility
  • If the Guest intends to pay the charges stipulated in Article 12 by any means other than Japanese currency, such as accommodation coupons or credit card, these shall be presented in advance at the time of registration stipulated in the preceding paragraph.

Guest rooms Occupancy Time

Article 9

  • Guests may use Guest rooms of this facility from 3:00 PM to 12:00 PM the following morning. However, in the case of consecutive stays, guests may use the rooms all day except on the days of arrival and departure.
  • Notwithstanding the provisions of the preceding paragraph, this facility may permit use of Guest rooms outside of the hours specified in the same paragraph. In such cases, an additional fee will be charged.
    • If you check out after 12:00 PM
    • If you check in before 3pm

Compliance with Terms of Use

Article 10

While staying at this facility, guests must abide by the usage regulations established by this facility and posted within the facility, as well as any other regulations established by the facility.

Opening times

Article 11

  • The opening hours of this facility are as follows. Detailed opening hours of other facilities will be provided in the pamphlets provided and on notices posted in various locations.

    Front desk/cashier service hours:
    • No curfew
    • Front desk service: 24 hours (cashier only 7:00-24:00)

  • The dates set out in the preceding paragraph may be subject to temporary change if necessary or unavoidable. Facilities may also be closed without prior notice. In such cases, we will notify you by appropriate means.

Payment of fees

Article 12

  • The breakdown and calculation method of the Accommodation Charges, etc. to be paid by the Guest shall be as set forth in Schedule 1.
  • Payment of accommodation fees, etc. in the preceding paragraph shall be made at the front desk at the time of departure of the guest or upon request by this facility, in currency or by any alternative means accepted by this facility, such as traveler's checks, accommodation vouchers, or credit cards.
  • Accommodation fees will be charged even if the guest voluntarily does not stay in the room after the facility has provided the guest with Guest rooms and it is available for use.

Responsibilities of this facility

Article 13

  • This facility will compensate the guest for any damages it has caused to the guest in the course of fulfilling or failing to fulfill the accommodation contract and related agreements. However, this does not apply if the damages are not due to reasons attributable to this facility.
  • Our facility is in compliance with fire safety laws and regulations, and displays a fire safety standard compliance certificate that certifies the fire safety of the accommodation facility.

Handling when contracted Guest rooms cannot be provided

Article 14

  • When this facility is unable to provide a contracted Guest rooms to a guest, it will, with the guest's consent, arrange accommodation at another accommodation facility with the same conditions as far as possible.
  • If, despite the provisions of the preceding paragraph, it is unable to arrange other accommodation for the guest, this facility will pay the guest a compensation fee equivalent to the contract fee, which will be used to cover damages. However, if the inability to provide Guest rooms is due to reasons not attributable to this facility, the facility will not pay a compensation fee.

Handling of deposited items

Article 15

  • In the event that damage such as loss or breakage occurs to goods, cash, or valuables deposited by a guest at the facility, this facility will compensate for such damage, unless it is due to force majeure. However, in the case of cash and valuables, if this facility requests a declaration of their type and value and the guest fails to do so, this facility will compensate for such damage up to a maximum of 300,000 yen.
  • This facility will compensate for damages incurred by guests who have not brought goods or cash into this facility or valuables that they have not deposited at the front desk due to the facility's intentional or negligent actions. However, for items for which the guest has not previously reported the type and value, this facility will compensate for such damages up to a maximum of 100,000 yen.

Storage of Guest's baggage and belongings

Article 16

  • If the guest's baggage arrives at this facility prior to their stay, this facility will be responsible for storing it only if this facility has given its consent in advance, and will hand it over to the guest at the front desk when they check in.
  • If a guest's baggage or belongings are found left behind at the facility after check-out, and there is no instruction from the owner or the owner cannot be identified, the facility shall comply with the provisions of Article 8 of the Terms of Use.
  • The Facility's liability regarding the custody of the Guest's baggage or personal belongings in the cases of the preceding two paragraphs shall be in accordance with the provisions of Paragraph 1 of the preceding Article in the case of Paragraph 1, and in accordance with the provisions of Paragraph 2 of the same Article in the case of the preceding paragraph.
  • In addition to the provisions of the preceding Article and the preceding three paragraphs, details regarding the handling of deposited items and the storage of baggage and personal effects of guests shall be governed by the Deposit Regulations separately established by this facility.

Parking Responsibility

Article 17

When a guest uses the parking lot of this facility, regardless of whether the guest has deposited the vehicle key, this facility is merely lending the space and is not responsible for the management of the vehicle. However, if damage is caused intentionally or negligently by this facility in the management of the parking lot, this facility will be liable for compensation.

Liability of the Guest

Article 18

If this facility suffers damage due to the guest's willful misconduct or negligence, the guest will be required to compensate this facility for the damage.

Computer Communications Disclaimer

Article 19

Customers shall use computer communications from within the Facility at their own risk. The Facility shall not be held responsible for any damages suffered by users as a result of service interruptions due to system failures or other reasons while using computer communications. Furthermore, if damages are caused to the Facility or third parties due to actions that the Facility deems inappropriate while using computer communications, the customer shall compensate for such damages.

Article 20

These regulations are written in both Japanese and English, but in the event of any discrepancies or discrepancies between the two versions, the Japanese version shall prevail.

Jurisdiction and Applicable Law

Article 21

Any disputes arising from these regulations shall be resolved in accordance with Japanese law in a Japanese court with jurisdiction over the location of the Facility.

  • The percentage is the ratio of the penalty to the basic accommodation fee.
  • If the number of days of the contract is shortened, a penalty for one day (the first day) will be charged regardless of the number of days shortened.
  • If a contract is terminated for part of a group of 15 or more people, no penalty will be charged for the number of people that is 5% (rounded up to the nearest whole number) of the guests staying at the hotel as of 10 days prior to the date of stay (or, if the booking is accepted after that date, the date of acceptance).
  • In the case of a group of 15 or more people, if a special accommodation contract is concluded and a penalty fee contract is specified, the penalty fee shall be in accordance with that contract.
