Terms and Conditions for Accommodation Contracts(A)

Scope

Article 1

  • All accommodation contracts and related agreements to be concluded between this hotel and the Guest to be accommodated shall be subject to these Terms and Conditions. Any matters not provided for in these Terms and Conditions shall be governed by laws and regulations (meaning laws and regulations or those based on laws and regulations; the same applies hereinafter) or generally accepted practices.
  • In cases in which the Hotel has entered into a special contract with the Guest insofar as such special contract does not violate laws and regulations and generally accepted practices, notwithstanding the provisions of the preceding paragraph, the special contract shall take precedence over the provisions of the preceding paragraph.

Application for accommodation contract

Article 2

  • A Guest who intends to apply for an Accommodation Contract with the Hotel shall provide the Hotel with the following particulars:
    • Guest name
    • Date of stay and expected arrival time
    • Accommodation fees (in principle, based on the basic accommodation fees in Appendix 1)
    • Other particulars deemed necessary by the Hotel
  • If a Guest requests, during his/her stay, to extend his/her stay beyond the date specified in subparagraph 2 of the preceding paragraph, the Hotel will regard such request as an application for a new Accommodation Contract at the time such request is made.

Establishment of accommodation contract, etc.

Article 3

  • An accommodation contract shall be established when the hotel accepts the application as described in the preceding article. If the hotel does not accept the application, the accommodation contract shall not be established.
  • When an Accommodation Contract has been concluded in accordance with the provisions of the preceding paragraph, the Hotel may request payment of a reservation deposit up to the accommodation fees for the accommodation period.
  • The reservation deposit shall first be applied to the accommodation fee finally payable by the Guest, then, in the case specified in Article 6, to the penalty charges specified in the same Article, and in the case where the provisions of Article 18 apply, it shall be applied first to the penalty charges and then to compensation, and the remainder, if any, shall be returned at the time of payment of the accommodation fee as specified in Article 12.
  • If the Hotel displays an incorrect accommodation rate on an internet site or provides an incorrect accommodation rate over the telephone, and a reservation application for an accommodation contract is made and accepted by the Hotel, and the rate in question is significantly lower than the Hotel's regular accommodation rates, the Hotel may notify the Guest that the rate in question and the acceptance of the reservation application for the accommodation contract and the accommodation contract based thereon are to be cancelled as a "juridical act due to mistake" as stipulated in Article 95 of the Civil Code.In such case, the accommodation contract and the reservation application for the accommodation contract will be cancelled when the person who made the reservation for the accommodation contract receives said notice.

Special agreement not requiring payment of a reservation deposit

Article 4

  • Notwithstanding the provisions of Paragraph 2 of the preceding Article, the Hotel may enter into a special contract requiring no reservation deposit after the Contract has been concluded.
  • If the Hotel has not requested the payment of the reservation deposit as stipulated in Paragraph 2 of the preceding Article and/or has not specified the due date for the payment of the reservation deposit at the time of accepting your application for an Accommodation Contract, it will be treated as if the Hotel has accepted the special contract stipulated in the preceding Paragraph.

Request for cooperation in infection prevention measures at facilities

Article 4-2

Our Hotel reserves the right to request that Guests who wish to stay at our Hotel comply with the provisions of Article 4-2, Paragraph 1 of the Inns and Hotels Act (Act No. 138 of 1948).

Refusal to enter into an accommodation contract

Article 5

The Hotel may refuse to enter into an Accommodation Contract under any of the following cases:

  • When the application for accommodation does not conform to these terms and conditions.
  • When the Hotel is fully booked and there are no Guest rooms available.
  • When the person seeking accommodation is deemed to be in danger of engaging in conduct that will violate the provisions of the law, the public order or good morals in regard to his/her accommodation.
  • When the person seeking accommodation is deemed to fall under any of the following items (a) to (c):
    • An organized crime group as defined in Article 2, Paragraph 2 of the Law Concerning Prevention of Unjust Activities by Organized Crime Group Members (Law No. 77 of 1991) (hereinafter referred to as an "organized crime group"), an organized crime member as defined in Article 2, Paragraph 6 of the same Law (hereinafter referred to as an "organized crime member"), an associate member of an organized crime group, or a person related to an organized crime group, or other anti-social forces.
    • When a corporation or other organization whose business activities are controlled by an organized crime group or an organized crime member
    • A corporation in which any of its directors is a member of an organized crime group
  • When a person seeking accommodation behaves in a manner that is a significant nuisance to other guests.
  • When the person seeking accommodation is a patient, etc. of a specific infectious disease as defined in Article 4-2, Paragraph 1, Item 2 of the Inns and Hotels Act (hereinafter referred to as "Patients, etc. of a specific infectious disease").
  • When violent demands are made in relation to accommodation, or an unreasonable burden is asked of the person seeking accommodation (excluding cases where the person seeking accommodation requests the removal of social barriers pursuant to the provisions of Article 7 Paragraph 2 or Article 8 Paragraph 2 of the Act on Promotion of Elimination of Disability Discrimination (Act No. 65 of 2013; hereinafter referred to as the "Disability Discrimination Elimination Act").
  • When a person seeking accommodation has repeatedly made requests which are deemed to be excessively burdensome and likely to significantly impede the provision of accommodation services to other guests as specified in Article 5-6 of the Enforcement Regulations of the Inns and Hotels Act.
  • When the person seeking accommodation is deemed to have previously posted libelous, slanderous, threatening or inflammatory content about the Hotel or its employees on social media, thereby disrupting the operation of the Hotel or damaging the credibility and brand of the Hotel and the Hotel Group.
  • When it is impossible to provide accommodation due to natural disasters, malfunctions of facilities, or other unavoidable reasons.
  • When the case falls under the circumstances specifically provided for in prefectural ordinances.

Explanation for refusal to enter into an accommodation contract

Article 5-2

If the Hotel does not comply with the entry into an Accommodation Contract in accordance with the preceding Article, a Person seeking accommodation may request an explanation from the Hotel for the reason.

Guest's Right to Cancel Accommodation Contract

Article 6

  • The Guest may cancel the Accommodation Contract by notifying the Hotel.
  • In the event that the Guest cancels the Accommodation Contract in whole or in part due to reasons attributable to the Guest (except in the event that the Hotel has specified a due date for the payment of the reservation deposit pursuant to the provisions of Article 3, Paragraph 2 and requested such payment, and the Guest cancels the Accommodation Contract prior to such payment), the Hotel shall charge a penalty as listed in Attached Table 2. However, in the event that the Hotel has entered into a special contract as set forth in Article 4, Paragraph 1, this shall apply only when the Hotel has notified the Guest of the obligation to pay the penalty in the event that the Guest cancels the Accommodation Contract, in accordance with such special contract.
  • If a Guest does not arrive at the scheduled arrival time on the day of accommodation without contacting the Hotel, the Hotel may regard the Accommodation Contract as having been cancelled by the Guest.

Right to Cancel Contract by the Hotel

Article 7

  • The Hotel may cancel the Accommodation Contract under any of the following circumstances:
    • When the Guest is deemed liable to conduct himself/herself in a manner that will violate the laws, public order or good morals in regard to his/her accommodation, or when he/she is deemed to have conducted such conduct.
    • When the Guest is deemed to be one of the following (a) to (c):
      • Organized crime group, organized crime group member, associate member of an organized crime group, or related person to an organized crime group or other antisocial forces
      • When a corporation or other organization whose business activities are controlled by an organized crime group or an organized crime member
      • A corporation in which any of its directors is a member of an organized crime group
    • When the Guest behaves in a manner that causes significant nuisance to other Guests.
    • When the guest is a patient of a specific infectious disease.
    • When violent demands are made in relation to the accommodation, or an unreasonable burden is asked of the guest (except when the guest requests the removal of social barriers pursuant to Article 7 Paragraph 2 or Article 8 Paragraph 2 of the Act on the Elimination of Discrimination against Persons with Disabilities).
    • When the Guest has repeatedly made requests to the Hotel which are deemed to be excessively burdensome and likely to significantly impede the provision of accommodation services to other Guests as specified in Article 5-6 of the Enforcement Regulations of the Inns and Hotels Act.
    • When the Guest posts or is likely to post libel, slander, or intimidation about the Hotel or its employees on social media with the intent of causing an uproar, or obstructs the operation of the Hotel or tarnishing the credibility and brand of the Hotel and the Hotel Group, or is deemed to have engaged in similar behavior in the past.
    • When it is impossible to provide accommodation due to a natural disaster or other force majeure event.
    • Pets are allowed indoors (excluding assistance dogs for the physically disabled).
    • When the facility is used by more than the number of people who have applied.
    • When a person other than the registered guest enters or stays in the room.
    • When the case falls under the circumstances specifically provided for in prefectural ordinances.
    • When the Guest smokes in bed, tampers with fire-fighting equipment, etc. or fails to observe any other prohibited activities stipulated in the Usage Regulations stipulated by the Hotel (limited to those necessary for fire prevention purposes).
    • When payment is not made by the specified payment date (in this case, Article 16 Paragraph 2 shall apply mutatis mutandis to the Guest's baggage, etc.).
  • When the Hotel has cancelled the Accommodation Contract in accordance with the preceding paragraph, the Hotel shall not charge the Guest for any accommodation services etc. which he has not yet received.

Explanation of accommodation contract cancellation

Article 7-2

When the Hotel has cancelled the Accommodation Contract in accordance with the preceding Article, the Guest may request the Hotel to explain the reason therefor.

Accommodation Registration

Article 8

  • The Guest will be required to register the following particulars at the Hotel front desk on the day of accommodation:
    • The guest's name, address and contact details.
    • For foreigners not residing in Japan, nationality, passport number and a copy of the passport.
    • Any other particulars deemed necessary by the Hotel.
  • If a Guest intends to pay the charges stipulated in Article 12 by any means other than Japanese currency, such as accommodation coupons or credit card, these shall be presented in advance at the time of registration stipulated in the preceding Paragraph.

Guest rooms Occupancy Time

Article 9

  • The time during which a Guest may occupy Guest rooms of the Hotel shall be from the check-in time to the check-out time specified by the Hotel.
  • Notwithstanding the provisions of the preceding paragraph, the Hotel may permit Guest rooms to occupy the room outside the hours specified in the same paragraph. In this case, an additional fee as specified by the Hotel will be charged.

Observance of the rules of use

Article 10

Guests are required to observe the Hotel Usage Regulations established by the Hotel and posted within the premises of the Hotel.

Opening times

Article 11

  • Detailed information about the opening hours of the hotel's main facilities will be provided in the pamphlets provided, on notices posted in various locations, and in the service descriptions provided in Guest rooms.
  • The hours set out in the preceding paragraph may be subject to temporary change due to unavoidable circumstances. In such cases, we will notify you by appropriate means.

Payment of fees

Article 12

  • The breakdown of the accommodation fees, etc. to be paid by the Guest shall be as set forth in Attached Table 1.
  • The accommodation charges, etc. as stipulated in the preceding paragraph shall be paid in Japanese currency or by any other means acceptable to the Hotel, such as accommodation coupons or credit cards, at the front desk upon the Guest's arrival or upon request by the Hotel.
  • Accommodation charges will be charged even if the Guest voluntarily does not utilize the guest Guest rooms after the Hotel has provided it to the Guest and made it available for use.

Liability of the Hotel

Article 13

The Hotel shall compensate the Guest for damages caused to the Guest in the fulfillment or nonfulfillment of the Accommodation Contract and/or related agreements, unless such damages have been caused by reasons beyond the Hotel's control.

When we are unable to provide the contracted Guest rooms

Article 14

When the Hotel is unable to provide a contracted Guest rooms to a Guest, it will, with the Guest's consent, arrange for the Guest to stay in similar accommodation elsewhere wherever possible.

Handling of deposited items

Article 15

The Hotel shall not be liable for any loss, breakage or other damage caused to articles, cash or valuables brought into the Hotel by the Guest, unless such loss or damage is caused by willful misconduct or gross negligence on the part of the Hotel.

Storage of Guest's baggage and belongings

Article 16

  • When the baggage of the Guest is brought into the Hotel prior to his/her stay, the Hotel shall be responsible for storing it only when such request has been approved in advance and shall hand it over to the Guest at the front desk at the time of his/her check-in.
  • If a guest's baggage or belongings are found left behind at the hotel after checking out, and the owner is identified, the hotel will ask the owner for further instructions. However, if there is no instruction from the owner or the owner is not identified, the hotel will store the items for seven days, including the day they were found, after which valuables will be turned over to the nearest police station and other items will be disposed of (food, drink, magazines, and newspapers will be disposed of on the same day).

Parking Responsibility

Article 17

When a guest uses the hotel's parking lot, regardless of whether the key to the vehicle has been deposited with the hotel, the hotel is merely lending the space and is not responsible for the management of the vehicle. However, if the hotel causes damage through intentional or gross negligence in the management of the parking lot, the hotel will be liable to pay compensation.

Liability of the Guest

Article 18

When the Hotel suffers damage caused through intention or negligence on the part of the Guest, the Guest will compensate the Hotel for the damage.

Other

Article 19

For the purpose of audits and investigations of the Hotel, personal information of guests listed on the accommodation card may be provided to parties entrusted with the management or leasing of the Hotel to the Hotel. Guests agree to the provision of such personal information.

Article 20

In the event of any violation of these terms and conditions and any dispute arising, you agree that the Tokyo District Court shall be the court with jurisdiction, regardless of your address.

Article 21

If all or part of the Hotel is destroyed or damaged and becomes impossible to use due to a natural disaster or other cause for which the Hotel is not responsible, the Accommodation Contract will automatically terminate.

Article 22

The accommodation contract between the Guest and the Hotel shall be governed by and construed in accordance with the laws of Japan.

Article 23

If Terms and Conditions for Accommodation Contracts is written in multiple languages and there is any inconsistency, discrepancy, contradiction or other discrepancy between the descriptions in each Terms and Conditions for Accommodation Contracts, the contents of Terms and Conditions for Accommodation Contracts written in Japanese shall take precedence.

Sign-in
